Terms of Service

1. Acceptance of Terms

By accessing or using any service provided by AlertStream, including the FlowAlert mobile application, web dashboard, or API (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all users, including visitors, registered users, and paying customers.

2. Description of Service

AlertStream provides software tools that enable businesses to send, route, and manage push notifications and real-time alerts. The Service includes mobile applications for iOS and Android, a web-based dashboard, and a REST API for programmatic event ingestion and management.

3. Account Registration

To use certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your account credentials
• Promptly update your account information if it changes
• Accept responsibility for all activity under your account
• Notify us immediately of any unauthorised access to your account

AlertStream reserves the right to refuse registration or terminate accounts at our discretion.

4. Acceptable Use

You agree not to use the Service to:

• Send spam, unsolicited messages, or abusive notifications
• Violate any applicable laws or regulations
• Infringe upon intellectual property rights of any third party
• Transmit malicious code, viruses, or harmful data
• Attempt to gain unauthorised access to our systems or other users' accounts
• Use the Service in a way that could damage, disable, or impair it
• Reverse-engineer, decompile, or disassemble any part of the Service
• Resell or sublicense access to the Service without written permission

5. API Usage

Access to the AlertStream API is subject to rate limits specified in your plan. You must not circumvent or attempt to circumvent rate limits. API keys are confidential — you are responsible for keeping them secure. AlertStream reserves the right to revoke API keys that are misused or in violation of these Terms.

6. Subscription and Billing

Some features of the Service require a paid subscription. By subscribing, you agree to pay the fees specified at the time of purchase. All fees are in USD unless otherwise stated.

• Subscriptions renew automatically unless cancelled before the renewal date
• You may cancel at any time; cancellation takes effect at the end of the current billing period
• Fees are non-refundable except where required by law or at our sole discretion
• We reserve the right to change pricing with 30 days' notice

7. Intellectual Property

The Service and all its content, features, and functionality — including but not limited to software, text, graphics, logos, and icons — are owned by AlertStream and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the Service in accordance with these Terms. No rights are granted beyond what is expressly stated.

8. User Content

You retain ownership of any data or content you submit to the Service ("User Content"). By submitting User Content, you grant AlertStream a limited licence to process and store it solely to provide the Service. You are solely responsible for the legality and accuracy of your User Content. AlertStream does not review User Content and is not liable for it.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. ALERTSTREAM DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALERTSTREAM AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE FEES PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Termination

AlertStream may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will survive.

12. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be resolved through binding arbitration, except where prohibited by law. You waive any right to participate in a class-action lawsuit or class-wide arbitration.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated by updating the "Last updated" date and, where appropriate, via email. Your continued use of the Service after changes constitutes acceptance of the new Terms.
